1. Acceptance of Terms

By creating an account and using Fourtrend, you agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use the app. Fourtrend is operated by an individual developer and is subject to change at any time.

2. Eligibility

You must be at least 18 years of age to use Fourtrend. By using the app, you represent and warrant that you meet this requirement. Users under 18 are strictly prohibited from using Fourtrend regardless of parental consent.

3. User Accounts

You are responsible for maintaining the confidentiality of your account credentials. You agree to provide accurate and complete information when creating your account. You are solely responsible for all activity that occurs under your account. You must notify us immediately of any unauthorized use of your account.

5. AI Generated Content

If your content uses AI generated imagery or tools, you must disclose this during the upload process. Fourtrend will display an AI disclosure badge on such content. Failure to disclose AI generated content may result in account suspension.

6. Swipe Rights & Leaderboard

Swipe rights are a measure of engagement on the platform. Fourtrend reserves the right to reset, adjust, or remove swipe rights counts at any time. Leaderboard rankings are updated in real time and are based on swipe rights accumulated within specified time periods.

7. Advertising

Fourtrend may display advertisements within the app. By using the app, you consent to the display of advertisements. Fourtrend uses Google AdMob to serve advertisements. You may see personalized ads based on your activity within the app.

8. Termination

Fourtrend reserves the right to suspend or terminate your account at any time, without notice, for conduct that violates these Terms or is harmful to other users, the app, or third parties. You may delete your account at any time through the Settings page.

9. Disclaimer of Warranties

Fourtrend is provided on an 'as is' and 'as available' basis without any warranties of any kind, either express or implied. Fourtrend does not warrant that the app will be uninterrupted, error-free, or free of viruses or other harmful components.

10. Limitation of Liability

To the fullest extent permitted by law, Fourtrend and its developer shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the app or any content posted by users.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States. Users in the European Union are also subject to applicable EU consumer protection laws and GDPR regulations.

12. Changes to Terms

Fourtrend reserves the right to update these Terms at any time. We will notify users of significant changes through the app. Continued use of the app after changes constitutes acceptance of the new Terms.

14. Prohibited Countries & Sanctions

Fourtrend complies with applicable international trade laws and sanctions. You may not use Fourtrend if you are located in a country subject to international sanctions or trade restrictions. By using Fourtrend, you represent that you are not located in any such jurisdiction.

15. International Use

Fourtrend is operated from the United States. If you access the app from outside the United States, you are responsible for compliance with your local laws. Some features may not be available in all countries due to local regulations.

16. Content Restrictions by Region

Certain content that is legal in some countries may be restricted or illegal in others. Users are responsible for ensuring that any content they upload complies with the laws of their country of residence. Fourtrend reserves the right to restrict access to content in specific regions where it may violate local laws.

17. Content Moderation & AI Scanning

Fourtrend uses Google Cloud Vision API to automatically scan uploaded photos for inappropriate, explicit, violent or harmful content before they are published. By uploading content to Fourtrend, you consent to your images being analyzed by Google Cloud Vision API. Images that violate our content standards will be automatically rejected and will not be stored on our servers. This scanning applies to all photos uploaded including profile pictures.

18. Advertising

Fourtrend displays advertisements powered by Google AdMob. Ads may appear after every 8 swipes. By using Fourtrend you consent to the display of personalized and non-personalized advertisements. Google AdMob may collect device identifiers and usage data to serve relevant ads. You can opt out of personalized advertising in your device settings under Privacy.

19. User Generated Content

"You retain ownership of all content you upload to Fourtrend. By uploading content, you grant Fourtrend a non-exclusive, royalty-free license to display and distribute your content within the app. You are solely responsible for ensuring your content does not violate any laws or third party rights. Fourtrend reserves the right to remove any content that violates our terms without notice."

20. Video Content

Videos uploaded to Fourtrend must not exceed 1 minute in length and 50MB in file size. While photos are automatically scanned for inappropriate content, videos rely on user reporting and manual review. Users are responsible for ensuring their video content complies with our community standards and applicable laws.

21. Social Media Links

Promoters may add links to external social media platforms including Instagram, YouTube, Facebook, TikTok, Pinterest, Etsy, Amazon and others. Fourtrend is not responsible for the content of external websites or platforms. All external links display a safety warning before redirecting users. Fourtrend does not endorse any external content or platforms linked by promoters.

22. Leaderboard

The Fourtrend leaderboard displays creators ranked by total swipe rights. Leaderboard data is updated in real time and reflects genuine user engagement. Fourtrend reserves the right to remove users from the leaderboard if they are found to be engaging in fraudulent activity such as artificially inflating swipe rights counts.

23. Leaderboard Integrity

Fourtrend maintains the integrity of its leaderboard by monitoring for fraudulent activity. Users found to be artificially inflating swipe rights through automated tools, bots, or coordinated manipulation will have their accounts suspended and removed from the leaderboard. All leaderboard rankings reflect genuine user engagement only.

24. App Updates

Fourtrend may release updates to improve functionality, fix bugs, or add new features. Some updates may be required to continue using the app. We recommend keeping the app updated to the latest version for the best experience and security.

25. Limitation on Posting

Users may post content in all four categories: Photos, Videos, Products, and Services. Videos are limited to 1 minute in length and 50MB in file size. Photos are automatically scanned for inappropriate content before being published. Fourtrend reserves the right to impose additional posting limits at any time.

26. Third Party Services

Fourtrend integrates with the following third party services: Supabase (database and authentication), Google AdMob (advertising), Google Cloud Vision API (content moderation), and various social media platforms (Instagram, YouTube, Facebook, TikTok, Pinterest, Etsy, Amazon, Angi, Yelp). Each service has its own terms of service and privacy policy. By using Fourtrend you acknowledge and agree to the terms of these third party services.

27. DMCA Copyright Policy

Fourtrend respects intellectual property rights and complies with the Digital Millennium Copyright Act (DMCA). If you believe your copyrighted work has been used on Fourtrend without authorization, please send a DMCA takedown notice to our designated agent:Agent Name: Omer Sarfati Email: fourtrendapp@gmail.com Address: 463 Main Street Ste 1R PMB 3107 Little Falls, NJ 07424 Your notice must include: identification of the copyrighted work, identification of the infringing material, your contact information, a statement of good faith belief, and your signature. We will respond to valid DMCA notices within 48 hours.

28. Counter-Notification

If you believe your content was wrongly removed due to a DMCA notice, you may submit a counter-notification to our designated agent. Counter-notifications must include: identification of the removed content, a statement under penalty of perjury that removal was a mistake, your consent to jurisdiction, and your signature.

29. Repeat Infringers

Fourtrend has a policy of terminating accounts of users who are repeat copyright infringers. Users who receive multiple valid DMCA takedown notices may have their accounts permanently suspended.

30. Intellectual Property

The Fourtrend name, logo, app design, and all related intellectual property are owned exclusively by Fourtrend and protected by copyright, trademark, and other intellectual property laws. You may not use our trademarks, logos, or branding without prior written permission.

31. User Content License

By uploading content to Fourtrend, you grant us a non-exclusive, royalty-free, worldwide license to display, distribute, and promote your content within the app. You retain full ownership of your content. This license ends when you delete your content or account. You represent that you own or have the right to share all content you upload.

32. Copyright Infringement Prevention

Fourtrend uses automated content scanning to prevent the upload of infringing content. However we cannot guarantee that all user generated content complies with copyright law. If you discover infringing content please use the flag button or contact our DMCA agent immediately.

33. GDPR Representative

For EU users, Fourtrend's representative for GDPR purposes can be contacted through the Support section in the app settings. We will respond to all GDPR related requests within 30 days.

34. Supervisory Authority

EU users have the right to lodge a complaint with their local data protection supervisory authority if they believe their data protection rights have been violated. A list of EU supervisory authorities can be found at edpb.europa.eu.

35. California Shine the Light

California Civil Code Section 1798.83 permits California residents to request information about disclosure of personal information to third parties for direct marketing purposes. Fourtrend does not disclose personal information to third parties for direct marketing purposes.

36. App Tracking Transparency

Fourtrend requests your permission to track your activity across other companies' apps and websites through Apple's App Tracking Transparency (ATT) framework. This tracking is used exclusively for serving personalized advertisements through Google AdMob. Specifically:If you allow tracking: Google AdMob uses your device's advertising identifier (IDFA) to show you relevant personalized ads based on your interests.If you decline tracking: Fourtrend will automatically opt you out of personalized advertising. You will still see ads but they will not be based on your interests or activity.You can change your tracking preference at any time in your iPhone Settings → Privacy & Security → Tracking → Fourtrend. Fourtrend does not use tracking data for any purpose other than advertising. Your tracking preference does not affect your ability to use any features of the app.

37. User Blocking Policy

Fourtrend provides a blocking system to protect users from abusive behavior. When you block another user: Their content is immediately and permanently removed from your feed. They cannot view your profile or content. Fourtrend is automatically notified of the block for monitoring and safety purposes. The blocked user is not notified that they have been blocked. You can manage and unblock users at any time through Settings → Blocked Users. Fourtrend takes all blocks seriously. Users who are frequently blocked may be subject to account review and potential suspension. Blocking is intended for genuine safety concerns and not for competitive or spiteful purposes.

38. Content Removal

When a user is blocked their content is immediately removed from the blocking user's feed. This removal is instant and does not require manual review. The blocked user's content remains visible to other users unless it is separately reported and removed through our content moderation process. Fourtrend reserves the right to remove any content that violates our community standards at any time without notice.
